2025-75 Amending Section 12.28.072, entitled, “Mooring permit classification and quotas” and 12.28.072, entitled, “Requests for mooring permit and permit changes”

AN ORDINANCE IN AMENDMENT OF TITLE TWELVE OF THE CODIFIED ORDINANCES OF THE CITY OF NEWPORT, RHODE ISLAND, REVISION OF 1994, AS AMENDED, ENTITLED, "STREETS, SIDEWALKS AND PUBLIC PLACES."

BE IT ORDAINED by the City of Newport:

SECTION 1. Chapter 12.28 of the Codified Ordinances of the City of Newport, Revision of 1994, as amended, entitled "City Harbor," is hereby further amended as follows:

12.28.072. - Requests for mooring permit and permit changes.

ADD:

D. Conversion of rental mooring permit to a private mooring are permitted subject to the following:

1. Rental Mooring permits held by limited liability companies, Corporations, trustees of trusts, or trusts themselves, may be converted to a Private Mooring in the name of one individual with an equity interest in the limited liability company or corporation or who is a beneficiary of the trust upon proper documentation of authority to agree to the conversion

2. A Rental Mooring held by one or more individuals may be converted to a Private Mooring in the name of one of the existing permit holders.

3. No person who is already the holder of a Private Mooring permit may convert a Rental Mooring permit to a Private Mooring permit. Individuals, may only hold one Private Mooring permit.

4. A Rental Mooring converted to a Private Mooring may not be converted back to a Rental Mooring.

SECTION 3. This ordinance shall take effect upon its passage and all ordinances or parts of ordinances inconsistent herewith are hereby repealed.
