WHEREAS:

The Town of Middletown put forward a request for proposals for materials testing and special inspection services for the Middle-High School and Elementary School Complex construction and renovation. The town received the responses, and Colliers evaluated the responses and forwarded a recommendation to the School Building Committee,

and,

WHEREAS:

The School Building Committee agreed to recommend Prime Consulting,

and,

RESOLVED:

That the Town Council approve the recommendation for materials testing and special inspection services for the Middle-High School and Elementary School Complex construction and renovation to Prime Consulting of Norton, MA for the amount not to exceed one hundred seventy-five thousand five hundred twenty dollars and zero cents ($175,520.00), subject to a mutually agreed upon contract,

and,

BE IT FURTHER RESOLVED:

That funding for this proposal is to be from the School Improvement Bond Proceeds and all expenses recorded in the School Department’s Capital Projects Fund,

and,

BE IT FURTHER RESOLVED:

That the Town Administrator is authorized hereby to execute an agreement on behalf of the Town of Middletown.

Gilbane Building Company has put forward a bid package for sitework services for the construction of the Middle-High School project. The responses that were received and evaluated by Gilbane Building Company and a recommendation was forwarded to the Town Administrator and School Building Committee,

and,

WHEREAS:
The School Building Committee and Town Administrator have agreed to forward the recommendation to the Town Council,

and,

RESOLVED:
That the Town Council approve the recommendation for Gilbane Building Company to award the subcontract of sitework services for the construction of the Middle-High School project to DiGregorio Corporation of Smithfield, RI in the amount of twelve million one hundred seventy-four thousand dollars and zero cents ($12,174,000.00) and an owner allowance for unsuitable soil disposal of two million six hundred seventy-five thousand dollars and zero cents ($2,675,000.00).

RESOLVED:

That the Town Council approve the recommendation for Gilbane Building Company to award the subcontract of structural steel for the construction of the Middle-High School project to Shepard Steel Co Inc. of Hartford, CT in the amount of seven million fifty-two thousand five hundred dollars and zero cents ($7,052,500.00)

That the funding for this proposal is to be from the School Improvement Bond Proceeds and all expenses recorded in the School Department’s Capital Projects Fund,

The School Building Committee and Town Administrator have agreed to forward the recommendation to the Town Council,

and,

RESOLVED:

That the Town Council approve the recommendation for Gilbane Building Company to award the subcontract of precondition surveying services for the construction of the Middle-High School project to Falvey Associates of Milford, MA in the amount of eleven thousand two hundred fifty dollars and zero cents ($11,250.00)

and,

BE IT FURTHER RESOLVED:

That the funding for this proposal is to be from the School Improvement Bond Proceeds and all expenses recorded in the School Department’s Capital Projects Fund,

3. Authorizing Resolution*

The following certification must be completed and submitted as part of the final application:

This is certified as a true copy of a resolution adopted by the Council of the Town of Middletown at a meeting held on Monday, May 5, 2025.

WHEREAS, funds are available under the Rhode Island Community Development Block Grant Program, administered by the Executive Office of Commerce, Office of Housing and Community Development; and,

WHEREAS, the Governor of the State of Rhode Island has authorized the Director of said Department/Office to disburse such funds; and,

WHEREAS, it is in the interest of the citizens of the Town of Middletown that application be made to undertake a local Community Development Block Grant Program.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF MIDDLETOWN

That the filing of this application for the amount of $975,000 to implement the activities proposed herein hereby authorized and that Shawn J. Brown (Chief Executive Officer) is hereby authorized and directed to file this application with the Office of Housing and Community Development, to provide any additional information or documents required by said office, to make any assurances required in connection with this program, to execute an agreement with the State of Rhode Island and to otherwise act as the Representative of the Town of Middletown in all matters relating to this application and any award which may be based upon this application.

TOWN OF MIDDLETOWN, RHODE ISLAND

RESOLUTION IN SUPPORT OF H5950 AND S849

WHEREAS, the Town of Middletown invests significant resources in the recruitment, training, and equipping of public safety personnel, including law enforcement officers, firefighters, and emergency medical services staff; and

WHEREAS, when such trained personnel are hired by other municipalities within the state shortly after completing their training, the initial investment made by the Town is effectively transferred without compensation; and

WHEREAS, House Bill 5950 and Senate Bill 849, introduced in the Rhode Island General Assembly, seek to establish a reimbursement system requiring municipalities that hire public safety personnel from another municipality within three years of their training to reimburse the original municipality for associated training and equipment costs; and (RI H5950 | BillTrack50)

WHEREAS, the proposed legislation outlines a prorated reimbursement schedule: 100% if the hire occurs within one year of training completion, 75% if between one and two years, and 50% if between two and three years; and

WHEREAS, the reimbursement would cover expenses such as basic and specialized training programs, uniforms, personal protective equipment, training materials, and a prorated portion of the employee's base salary and benefits during the training period; and (RI H5950 | BillTrack50)

WHEREAS, the Town of Middletown supports measures that promote fairness and sustainability in public safety operations, ensuring that municipalities are not unduly burdened by the loss of trained personnel to other jurisdictions without compensation;

NOW, THEREFORE, BE IT RESOLVED, that the Town Council of the Town of Middletown hereby expresses its support for the passage of House Bill 5950 and Senate Bill 849 and respectfully urges the Rhode Island General Assembly to adopt this important legislation.

Resolution in Support of Rhode Island Senate Bill 2025-S 0057 and House Bill 2025-H 5393
Relating to Sidewalk Maintenance on State Highways

WHEREAS, safe, accessible, and well-maintained sidewalks are essential for the mobility,
safety, and well-being of all Rhode Island residents, including seniors, students, persons with
disabilities, and pedestrians of all ages; and

WHEREAS, Senate Bill 2025-S 0057 and House Bill 2025-H 5393 propose to amend Rhode
Island General Laws to clarify that the State of Rhode Island shall be responsible for the
maintenance of sidewalks along state highways, with the exception of snow and ice removal; and

WHEREAS, municipalities across Rhode Island, including the Town of Middletown, are often
financially and operationally burdened by the requirement to maintain sidewalks along state-
controlled highways, diverting limited local resources from other essential public services; and

WHEREAS, assigning maintenance responsibility to the State will promote consistent standards
for repair and upkeep, improve pedestrian safety, ensure uniformity across municipal boundaries,
and allow towns and cities to better allocate resources to other critical infrastructure needs; and

WHEREAS, the Rhode Island League of Cities and Towns and several municipal leaders have
publicly supported this legislation, recognizing that sidewalk maintenance on state roads is
fundamentally a state responsibility tied to the state's transportation infrastructure; and

WHEREAS, the Town Council of Middletown finds that the passage of Senate Bill 2025-S
0057 and House Bill 2025-H 5393 would benefit local taxpayers, enhance public safety, and
support the Town’s long-term transportation and accessibility goals;

NOW, THEREFORE, BE IT RESOLVED, that the Town Council of Middletown, Rhode
Island, hereby formally endorses and supports the passage of Senate Bill 2025-S 0057 and House
Bill 2025-H 5393,

TOWN OF MIDDLETOWN, RHODE ISLAND

RESOLUTION IN SUPPORT OF RHODE ISLAND SENATE BILL 0043

WHEREAS, Senate Bill 0043, introduced in the Rhode Island General Assembly on January 23, 2025, proposes to amend Section 45-21-54 of the General Laws to increase the number of days a retired municipal employee may work in a calendar year without interruption of pension benefits from seventy-five (75) to ninety (90) days; and

WHEREAS, this legislative change would provide municipalities with greater flexibility to utilize the expertise of retired employees for temporary assignments, thereby addressing short-term staffing needs without compromising the financial stability of the pension system; and

WHEREAS, the proposed amendment maintains existing safeguards, ensuring that pension payments are suspended when the ninety (90) day threshold is exceeded, and clarifies that the rule does not apply to police officers working private details paid by nongovernmental entities; and

WHEREAS, the Town of Middletown recognizes the value of experienced retired personnel in maintaining continuity of services and meeting operational demands during peak periods or unforeseen circumstances; and

NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Middletown hereby expresses its support for the passage of Senate Bill 0043 and urges the Rhode Island General Assembly to enact this legislation.

BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the members of the Rhode Island Senate Finance Committee and the town's legislative delegation.

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MIDDLETOWN, RHODE ISLAND, IN SUPPORT OF HOUSE BILL 5793

WHEREAS, the Town of Middletown recognizes that Rhode Island is facing a critical shortage of affordable and workforce housing, which has contributed to rising housing costs, displacement of long-term residents, and economic challenges for municipalities seeking to attract and retain a diverse population; and

WHEREAS, House Bill 5793 (2025), introduced by Representatives Corvese and Kislak, amends Section 44-5-2 of the Rhode Island General Laws to provide an exemption to the property tax levy cap for municipalities that experience substantial new residential development that meets certain affordability standards; and

WHEREAS, the proposed legislation would permit municipalities to exclude the assessed value of newly constructed housing units from their maximum levy calculation for three years, provided the developments include at least 10% low- or moderate-income housing units and comply with local zoning and building codes; and

WHEREAS, the Town Council recognizes that the flexibility provided by House Bill 5793 (2025) would encourage responsible residential growth, create financial room to address associated infrastructure and service demands, and support broader community development goals without immediately burdening existing taxpayers; and

WHEREAS, the Town Council further acknowledges that encouraging the production of affordable housing through responsible legislative measures is essential to ensuring the Town remains inclusive, economically vibrant, and capable of meeting the needs of residents across all income levels; and

WHEREAS, House Bill 5793 (2025) maintains important fiscal safeguards by requiring municipalities to document and report the use of the exemption to the Rhode Island Division of Property Valuation and ensures that developments benefiting from the exemption are properly integrated into the local tax base after the transition period; and

WHEREAS, the Town of Middletown believes that local control combined with sensible state support is critical to addressing the housing shortage and supporting future generations of Rhode Islanders.

NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Middletown hereby expresses its strong support for House Bill 5793 (2025) and respectfully urges the members of the Rhode

WHEREAS:

The Town of Middletown incurs annual electricity costs for streetlights located on both town and state roads,

and,

WHEREAS:

The General Assembly passed legislation that provides the opportunity for cities and towns to purchase their streetlights from Rhode Island Energy and to upgrade the streetlights to more energy efficient LED fixtures,

and,

WHEREAS:

The Town of East Greenwich issued a Request for Proposal for converting its existing technology to LED technology, which the Town of Middletown is leveraging through a piggybacking provision,

and,

RESOLVED:

That the Middletown Town Council hereby awards the streetlight LED technology conversion project as follows: to RISE Engineering in the amount of eight hundred seventy-five thousand nine hundred fifty-three dollars and zero cents ($875,953.00); to Ubiequia in the amount of forty-five thousand three hundred five dollars and zero cents (45,305.00); to Rhode Island Energy in the amount of three hundred twenty-one thousand five dollars and zero cents ($321,005.00),

and,

BE IT FURTHER RESOLVED:

That funding for this project shall be provided in part through Rhode Island Energy’s on-bill repayment plan in the amount of six hundred seventy-two thousand five hundred seventy-seven dollars and no cents ($672,577.00), energy incentives from Rhode Island Energy totaling two hundred eight thousand one hundred sixty dollars and no cents ($208,160.00), and an allocation of three hundred sixty-one thousand five hundred twenty-six dollars and no cents ($361,526.00) from the General Fund,

and,

BE IT FURTHER RESOLVED:

That the Town Administrator is hereby authorized to execute agreements with Rhode Island Energy for the purchase of streetlights, energy incentives, and the on-bill repayment plan; to negotiate and execute agreements with RISE Engineering for the conversion and ongoing maintenance of the Town’s streetlights; and to negotiate and execute an agreement with Ubicquia for the streetlight control software, all subject to review and approval by the Town Solicitor. Furthermore, the Town Administrator is authorized to notify the Department of Transportation upon completion of the conversion, requesting that the agency assume responsibility for the streetlights.
