RESOLUTION

WHEREAS: The City of Newport operates the Water Pollution Control Facility under a long term Service Contract with Veolia Water Services Newport LLC, Contract No. 15-023, approved by City Council following a competitive qualifications based procurement in 2016. The Service Contract assigns responsibility for operation, maintenance, regulatory compliance, and delivery of certain capital improvements affecting treatment performance; AND
WHEREAS: The Primary Clarifiers are critical infrastructure that provide the first stage of solids removal in the wastewater treatment process. They operate continuously and are essential to meeting Rhode Island's Pollutant Discharge Elimination System permit requirements, as well as protecting public health and the environment; AND
WHEREAS: The current estimated contract value for the Primary Clarifier Capital Improvements is approximately $25 million, subject to final quantities, allowances, and change order adjustments as provided in the contract amendment. The base contract price reflected in the amendment represents initial construction pricing. The higher program level estimate accounts for quantity variability allowances and contingency consistent with prior Council practice; NOW THEREFORE, BE IT
RESOLVED: the Council Chair is authorized to sign said contract amendment on behalf of the City, and to authorize Robert Schultz Jr., General Manager & Chief Engineer, to execute all related documents, subject to final funding determination and compliance with applicable procurement and financing requirements, subject to favorable review by the City Solicitor.
