WHEREAS, City Council Resolution 2024-40 authorized award to 1899, LLC of Newport, RI, meeting all specifications included in RFP# 24-049, dated 20 March 2024, for mobile food and beverage provider at Easton's Beach; AND

WHEREAS, the City of Newport and 1899, LLC did enter into a Lease Agreement, in consideration of the covenants, conditions, agreements and stipulations of the Service Provider, date of execution 12 June 2024; AND

WHEREAS, Article I, section 12 of the Lease Agreement "Utilities", does indicate that Utilities, including gas, electricity, and water are not available for mobile food and beverage service use, indicating it shall be the responsibility of the Service Provider to furnish self-contained equipment to operate the mobile food and beverage service at Easton's Beach; AND

WHEREAS, 1899, LLC has requested to utilize electricity and water for the mobile food and beverage unit at Easton's Beach, by amending the original lease agreement to access these utilities at no cost to the City of Newport; AND

WHEREAS, the City of Newport and 1899, LLC have engaged in research and identified a way, at no cost to the City, for 1899, LLC to assume responsibility for one (1) of three (3) available electric meters at Easton's Beach and establish a RI Energy account for the electric service in their own name and billed directly to them; AND

WHEREAS, 1899, LLC will install a water submeter in the rotunda with a separate usage reader, in which the city will invoice 1899 LLC accordingly for water usage during the lease period, with 1899, LLC assuming all costs and expenses of transferring the electric service and for installing a separate water submeter: NOW THEREFORE BE IT

RESOLVED: the request from 1899, LLC to create this RI Energy utility account and install a separate water submeter for mobile food and beverage operations, at no cost
