MINUTES FOR THE REGULAR CITY COUNCIL

MEETING

The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held on October 9, 2024 at 6:30 p.m., Pell Elementary School, Cafeteria, 35 Dexter St., Newport, RI 02840

COMMISSIONER CEGLIE moved to approve the Consent Calendar in its entirety.  Seconded by COMMISSIONER NAPOLITANO and VOTED UNANIMOUSLY.

COMMISSIONER CEGLIE moved to adjourn as Board of License Commissioners and convene as Council.  Seconded by COMMISSIONER CEGLIE and VOTED UNANIMOUSLY.

a. Minutes of the Council meetings held September 11, 2024 and September 23, 2024, Workshop held on September 18, 2024, and Boards and Commission Interviews held October 1, 2024 (Approve)

b. Special Events:

COUNCILOR CEGLIE moved to approve the Consent Calendar in its entirety with the exception of item b(5).  Seconded by COUNCILOR NAPOLITANO  and VOTED UNANIMOUSLY.

2. Aquidneck Community Table, d/b/a Aquidneck Growers Market, 151 Swinburne Row, November 2, 2024 through April 26, 2025

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

APPOINTMENTS

** Public Sculpture Commission** - Paul Miller – (2-year term, expires 10/11/2025)

MAYOR KHAMSYVORAVONG moved to appoint Paul Miller to the Public Sculpture Commission. Seconded by COUNCILOR CEGLIE and voted 4-1 with COUNCILOR LIMA opposed.

** Historic District Commission** - William Finlay, Alternate – (3-year term, expires 10/9/2027)

MAYOR KHAMSYVORAVONG moved to appoint William Finlay. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

** Canvassing Authority** - Mary Ann Marin, Republican, Alternate – (6-year term, expires 3/1/2027)

MAYOR KHAMSYVORAVONG moved to appoint Mary Ann Marin. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

4. Memorandum from Christopher J. Behan, Esq., City Solicitor, re: Ann Street Pier Litigation (w/accompanying resolution)

CITY SOLICITOR BEHAN provided information to the Council regarding the litigation. COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

5.         Memorandum, re:  Seasonal Rentals- continued from September 25, 2024

The City Clerk provided a summary of the recommendations.  Louis Cardoni, and Hilary Marshall, local realtors, addressed the Council.   CITY MANAGER KENNEDY addressed the Council  COUNCILOR CEGLIE moved to receive the memorandum.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

6. Action Item #6324/24 – re: Extension of Service Agreement - Passport Pay by Phone App (w/accompanying resolution)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

7. Memorandum from the City Manager re: Fiscal Notes on Question 6 – Bond Measures

COUNCILOR CEGLIE moved to receive the memorandum. Seconded by COUNCILOR NAPOLITANO. CITY MANAGER KENNEDY addressed the Council. Jim Nolan, Finance Director, addressed the Council regarding the bond. The motion to receive was VOTED UNANIMOUSLY.

8.         Amending Chapter 10.56.010, entitled, “One-way streets designated-Signs required” (Second Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on second reading.  Seconded by COUNCILOR NAPOLITANO.    Discussion occurred among the Council.  Linda Stevenson, Dixon St., addressed the Council regarding the change.  The motion to approve was voted 4-1 with COUNCILOR LIMA opposed.
