MINUTES FOR THE REGULAR CITY COUNCIL

MEETING

SEPTEMBER 25, 2024

The following items of business, filed with the City Clerk under the Rules of the Council, came before the Council at a meeting held on September 25, 2024 at 6:30 p.m., at ~~City Hall~~~~,~~~~ ~~, Council Chambers*Pell Elementary School, Cafeteria, 35 Dexter St., Newport, RI 02840

COMMISSIONER CEGLIE moved to approve the Consent Calendar in its entirety.  Seconded by COMMISSIONER NAPOLITANO and VOTED UNANIMOUSLY.

COMMISSIONER CEGLIE moved to adjourn as Council and convene as Board of License Commissioners.  Seconded by COMMISSIONER NAPOLITANO and VOTED UNANIMOUSLY.

24.       Amending Chapter 13.12, entitled, “Sewer Service Charges”* (Second Reading)

MAYOR KHAMSYVORAVONG moved to adopt the ordinance on second reading.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOULSY.

b.            Special Events:

1.         Trinity Church, d/b/a Trinity Church Pumpkin Patch, Queen Ann Square; October 10-31, 2024 from 12:00 p.m. to 6:00 p.m. Monday through Friday and 10:00 a.m. to 6:00 p.m. Saturday and Sunday

COUNCILOR CEGLIE moved to adopt the Consent Calendar in its entirety.  Seconded by MAYOR KHAMSYVORAVONG and VOTED UNANIMOUSLY.

2.         Entertainment License, New, Class A (indoor), Pickled and Cured, Inc., d/b/a Thames Street Kitchen and Chanterelle Restaurant, 505 & 509 Thames St. to have entertainment Sunday through Saturday from 5:00 p.m. to 11:00 p.m. (Hearing)

COUNCILOR CEGLIE moved to close the public hearing and approve the license. Seconded by COUNCILOR HOLDER and voted 5-1 with COUNCILOR CARLIN opposed.

3.         Special Event Licenses, Audrain Automobile Museum/Ben Chester, d/b/a Cars & Coffee, Fort Adams State Park:

a.         September 29, 2024, from 8:00 a.m. to 10:00 a.m.

COUNCILOR CEGLIE moved to approve the license.  Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.

b.         October 13, 2024, from 8:00 a.m. to 10:00 a.m.

4.         Victualing License, New, WW Newport II, LLC, d/b/a Wally’s Quick Serve, 293 JT Connell Highway

COUNCILOR CEGLIE moved to approve the license. Seconded by COUNCILOR ARAMLI. The motion failed 0 in favor-6 opposed.

APPOINTMENTS

Historic Cemetery Advisory Commission – Penny Fitch (3-year term expires 10/26/2027)

MAYOR KHAMSYVORAVONG moved to appoint Penny Finch to the Energy and Environment Commission.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

REAPPOINTMENTS

Historic Cemetery Advisory Commission - Deborah Peart (3-year term expires 10/26/2027)

MAYOR KHAMSYVORAVONG moved to reappoint Deborah Peart to the Historic Cemetery Advisory Commission.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOUSLY.

6.         Memorandum, re:  Seasonal Rentals

COUNCILOR CEGLIE moved to continue the item to October 9, 2024.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOULSY.

7.         Action Item #6318/24 – RE: Adopt-an-Access Memoranda of Understanding for Cliff Walk Rights of Way (w/accompanying resolution)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

8.         Action Item #6319/24 – RE: Award of Bid # 642-108 - Two (2) 2024 Harley Davidson FLHTP Electra Glide Solo Law Enforcement Motorcycles (w/accompanying resolution)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

9.         Action Item #6320/24 – RE: Ordinance Revision – 10.56.010. – One-Way Streets Designated – Signs Required Dixon Street, Thames Street to Spring Street (w/accompanying ordinance)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying ordinance.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

10.       Action Item #6321/24 – RE:  Award of Contract – RIMPA-King Park Seawall Professional Services Design & Construction Services (w/accompanying resolution)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

11.       Action Item #6322/24 – RE:  Award of Bid #2025-061 – Murphy Field Tennis & Basketball Court Restoration (w/accompanying resolution)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

12.       Action Item #6323/24 – RE:  Amendment No. 2 – Contract 22-026 - Engineering Services Wastewater Rehabilitation Pilot Program (w/accompanying resolution)

COUNCILOR CEGLIE moved to receive the communication and adopt the accompanying resolution. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

13.       Carousel- X. Khamsyvoravong, M. Aramli

MAYOR KHAMSYVORAVONG introduced the resolution and moved for its passage.  Seconded by COUNCILOR CEGLIE and VOTED UNANIMOULSY.

14.        Amending Chapter 10.52.010. entitled, “Weight- Restricted Streets” (Second Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on second reading. Seconded by COUNCILOR NAPOLITANO. COUNCILOR HOLDER moved to amend the ordinance to change the direction of the streets. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

COUNCILOR CEGLIE moved to adopt the ordinance as amended. Seconded by COUNCILOR HOLDER and VOTED UNANIMOUSLY.

15.       Amending Chapter 17.04, entitled, “General Requirements” (Second Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on second reading. Seconded by COUNCILOR NAPOLITANO. Discussion occurred among the Council.

COUNCILOR ARAMLI moved to continue the ordinance for 30 days.  Seconded by COUNCILOR CARLIN.  The motion failed 3-3 with COUNCILOR NAPOLITANO, COUNCILOR CEGLIE and COUNILOR HOLDER opposed.  In favor- MAYOR KHAMSYVORAVONG, COUNCILOR ARAMLI and COUNCILOR CARLIN.

COUNCILOR CEGLIE moved to adopt the ordinance on second reading.  Seconded by COUNCILOR NAPOLITANO.  The motion failed 3-3 with COUNCILOR NAPOLITANO, COUNCILOR CEGLIE and COUNILOR HOLDER opposed.  In favor- MAYOR KHAMSYVORAVONG, COUNCILOR ARAMLI and COUNCILOR CARLIN.

16.       Amending Chapter 17.14, entitled, “Permitted Uses” (Second Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on second reading.  Seconded by COUNCILOR NAPOLITANO.

The motion failed 3-3 with COUNCILOR NAPOLITANO, COUNCILOR CEGLIE and COUNILOR HOLDER opposed.  In favor- MAYOR KHAMSYVORAVONG, COUNCILOR ARAMLI and COUNCILOR CARLIN.

17.       Amending Chapter 17.52, entitled, “Limited Business District” (Second Reading)

The motion failed 3-3 with COUNCILOR NAPOLITANO, COUNCILOR CEGLIE and COUNILOR HOLDER opposed.  In favor- MAYOR KHAMSYVORAVONG, COUNCILOR ARAMLI and COUNCILOR CARLIN.

18.       Amending Chapter 17.56, entitled ,“Waterfront Business District” (Second Reading)

The motion failed 3-3 with COUNCILOR NAPOLITANO, COUNCILOR CEGLIE and COUNILOR HOLDER opposed.  In favor- MAYOR KHAMSYVORAVONG, COUNCILOR ARAMLI and COUNCILOR CARLIN.

19.       Amending Chapter 17.60, entitled, “General Business District” (Second Reading)

The motion failed 3-3 with COUNCILOR NAPOLITANO, COUNCILOR CEGLIE and COUNILOR HOLDER opposed.  In favor- MAYOR KHAMSYVORAVONG, COUNCILOR ARAMLI and COUNCILOR CARLIN.

20.       Amending Chapter 17.78, entitled, “Accessory Uses, Buildings and Structures” (Second Reading)

Nicholas Armour, Zoning Officer, addressed the Council regarding the ordinance.  COUNCILOR ARAMLI moved to amend Section 17.08, entitled, “Definitions”, ordinance to change the definition of lot building coverage.  Seconded by COUNCILOR CARLIN and voted 4-2 with COUNCILOR CEGLIE and COUNCILOR NAPOLITANO opposed.

COUNCILOR ARAMLI moved to approve Section 17.78. Seconded by COUNCILOR CARLIN and voted 4-2 with COUNCILOR CEGLIE and COUNCILOR NAPOLITANO opposed.

21.       Amending Chapter 17.100, entitled, “Development Standards” (Second Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on second reading.  Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

22.       Amending Chapter 17.104, entitled, “Parking and Loading Standards” (Second Reading)

COUNCILOR CEGLIE moved to adopt the ordinance on second reading. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.

23.       Amending Section 17.08.010, entitled, “Definitions” (Second Reading) continued from September 11, 2024

COUNCILOR CEGLIE moved to adopt the ordinance on second reading. Seconded by COUNCILOR NAPOLITANO and voted 5-1 with COUNCILOR CEGLIE opposed.

24.     Amending Chapter 13.12, entitled, “Sewer Service Charges”* (Second Reading)

COUNCILOR CEGLIE moved to hear item No. 24 before the Consent Calendar. Seconded by COUNCILOR NAPOLITANO and VOTED UNANIMOUSLY.
