WHEREAS, the Aquidneck Community Table, d/b/a Aquidneck Grower's Market wishes to enter into an agreement with the City of Newport to operate a farmer's market on each Wednesday from 2 pm to 6 pm, beginning May 28, 2025 and ending October 30, 2025, on Memorial Blvd. between Edgar Court and Chapel Street; AND

WHEREAS, the Aquidneck Grower's Market did enter into a previous agreement with the City to operate said farmer's market during the 2024 season, being held at the same location, operating on the same day of the week at the same times; AND

WHEREAS, the parties agree that an annual licensing fee in the amount of $1,100.00 plus $200 license fee is a fair and reasonable fee for the issuance of this License, to reflect costs associated with the management of this site, and that this License Agreement covers the use of the Licensed Premises during these agreed upon times; AND

WHEREAS, the Licensee's use of the land in question shall be subject to the terms and provisions of any Lease Agreement to the City of Newport from the State of Rhode Island Department of Transportation for the land in question, if applicable, and if required, Licensee shall obtain any and all approvals that may be required by RIDOT for use of Licensed Premises in addition to approvals provided by this License Agreement. NOW THEREFORE BE IT:

RESOLVED: that the Newport City Council, hereby grants approval of the Farmer's Market License and proposed agreement between the City of Newport and the Aquidneck Community Table, on each Wednesday beginning May 28, 2025 through October 30, 2025 at Memorial Blvd between Edgar Ct and Chapel St from 2pm to 6pm, AND BE IT FURTHER

RESOLVED: that the City Manager is authorized to sign said Agreement on behalf of the City, upon review by the City Solicitor.
