AN ORDINANCE IN AMENDMENT OF TITLE 12 OF THE CODIFIED ORDINANCES OF THE CITY OF NEWPORT, RHODE ISLAND, REVISION OF 1994, AS AMENDED, ENTITLED, "STREETS, SIDEWALKS AND PUBLIC PLACES.

BE IT ORDAINED by the City of Newport:

SECTION 1. Chapter 12.32 of the Codified Ordinances of the City of Newport, RI, Revision of 1994, as amended, entitled, "Park and Recreation Areas," is hereby further amended, as follows:

DELETE SECTION 12.32.130 IN ITS ENTIRETY

12.32.130. Smoking prohibited on public beaches, in public parks and cliff walk.

A. No person shall smoke a cigarette, cigar, or other tobacco-related product on or within any beach or public park owned, operated, maintained or managed by the city.

B. No person shall dispose of cigarette butts, cigar butts, or any tobacco-related waste on or within any beach or public park owned, operated, maintained or managed by the city.

ADD IN LIEU THEREOF THE FOLLOWING:

12.32.130. Smoking prohibited on public beaches, in public parks and cliff walk.

A. No person shall smoke a cigarette, cigar, weed or plant or other tobacco-related product, pipe or vaping apparatus on or within any beach or public park owned, operated, maintained or managed by the city.

B. No person shall dispose of cigarette butts, cigar butts, weed, plant or any tobacco-related waste on or within any beach or public park owned, operated, maintained or managed by the city.

SECTION 2. This ordinance shall take effect upon its passage and all ordinances or parts of ordinances inconsistent herewith are hereby repealed.
