No.2026-64

WHEREAS: The City of Newport has designated the Director of Public Safety to implement, administer and enforce noise abatement enforcement; and

WHEREAS: Codified City ordinance 8.12.130 (B)(2) states “No person shall operate a vehicle with passenger or motorcycle registrations or a pickup truck at any time or under any condition of grade, load, acceleration or deceleration in such a manner as to exceed eighty-three (83) dB(A). Noise readings in excess of eighty-three (83) dB(A) measured from within twenty (20) feet, and noise readings measured beyond twenty (20) feet) as normalized by calculation to an equivalent noise level at twenty (20) feet in excess of eighty-three (83) dB(A) shall constitute a violation punishable by a fine as follow”; and

WHEREAS: The measurement of sound or noise shall be made with a sound level meter meeting the standards prescribed by A.N.S.I. The instrument shall be maintained in calibration and good working order. A calibration check shall be made of the system at the time of any noise measurement. Measurements recorded shall be taken so as to provide a proper representation of the noise source; and

WHEREAS: The City’s Information Technology (IT) Department researched, developed and constructed noise enforcement trailers to capture the vehicle, registration plate and noise meter levels for mobile deployment police enforcement noise abatement; and

WHEREAS: The Police Department uses two automated noise enforcement trailers as equipment to implement, administer and enforce noise abatement in the city; and

WHEREAS: One of the Police Department’s Noise Enforcement Trailers was decommissioned due to old equipment and failure.

WHEREAS: The City’s IT Department obtained a quote for a cordless (battery powered) ATS-5 Surveillance trailer and associated noise abatement equipment and technology to replace the previous decommissioned noise enforcement trailer. NOW THEREFORE BE IT

RESOLVED: The purchase of one ATS-5 Surveillance ready trailer with all equipment, hardware and technology at a cost of $21,708.28, for Police Department use to enforce noise abatement from All Traffic Solutions LLC through the Sourcewell Mass Purchasing Agreement, is hereby approved subject to favorable review by the City Solicitor.
