RESOLUTION

OF THE
COUNCIL
No.2024-101

WHEREAS: the Rhode Island Coastal Resources Management Council ("CRMC") provides an "Adopt-an-Access" program which preserves and promotes the safe and unobstructed use by the public of CRMC designated rights-of-way to the shore; and

WHEREAS: By resolution of the Council passed on December 11, 2013, the City Council authorized the City to enter into Memoranda of Understanding with the CRMC and Clean Ocean Access concerning six rights-of-way access points along Cliff Walk under the CRMC Adopt-an-Access program; and

WHEREAS: Friends of the Waterfront ("FOW") has expressed a willingness to step into the shoes of Clean Ocean Access which has ceased to exist as a partner in the Adopt an Access program for the Cliff Walk CRMC designated rights of way Webster Street – CRMC Designation Z-1; Narragansett Avenue/Forty Steps – CRMC Designation Z-2; Ledge Road – CRMC Designation Z-3; Ruggles Avenue – CRMC Designation Z-4; Seaview Avenue – CRMC Designation Z-5; and Marine Avenue – CRMC Designation Z-6; and

WHEREAS: under the Adopt-an-Access program, a Memorandum of Understanding is required to be executed by each of the parties which sets forth the specific responsibilities and tasks to be performed under this program; and

WHEREAS: whereas the Memoranda previously entered into between the City, CRMC and Clean Ocean Access are identical to those hereby proposed to be entered into by the City, CRMC and FOW and are necessary to substitute FOW in place of Clean Ocean Access in order to provide continuity of the program. NOW THEREFORE, BE IT

RESOLVED: that the Memoranda of Understanding between CRMC, the City of Newport and FOW for each of the above referenced Cliff Walk CRMC rights of way are approved and the Mayor is authorized to sign the same, upon further review and approval by the City Solicitor.
