WHEREAS, in 1998, the City of Newport entered into a lease agreement with Omnipoint Communications, now known as T-Mobile Northeast, LLC (Lessee), for a period of 25 years, at the Lawton Valley facility, located at 2154 West Main Rd. Portsmouth, RI for the placement of certain cellular equipment; and

WHEREAS, such agreement did expire in 2023, and the lessee desires to enter into this first amendment in order to extend the term of the agreement for an additional 25 years, where Lessee shall pay a rent of $3,000 per month, with an increase equal to three percent (3%) annually; and

WHEREAS, that this new agreement shall be reinstated in its entirety, as amended herein in all respects as if the agreement never expired, for a period of 5 years, with four additional five-year renewal options. NOW THEREFORE BE IT

RESOLVED: that the Newport City Council hereby approve this agreement, and authorize the Council Chair to sign this Lease Agreement Amendment on behalf of the City, subject to review and approval of the document by the City Solicitor.
