RESOLUTION

OF THE
COUNCIL

No. 2026-44

WHEREAS: The Director of Public Services recommended exercising option year two (2) to the agreement with 1899, LLC, of Newport, RI, to provide mobile food and beverage concessions at Easton’s Beach; and

WHEREAS: City Council Resolution 2024-40 authorized award to 1899, LLC, of Newport, RI, meeting all specifications included in RFP# 2024-49, dated March 20, 2024, for a mobile food and beverage provider at Easton’s Beach, for a period of one (1) year, and three (3) additional one-year option periods at the discretion of the City, including an annual payment to the City of $72,000 and ten percent (10%) of the taxable gross sales of all products at Easton’s Beach in excess of $750,000; and

WHEREAS: City Council Resolution 2025-71 amended the lease agreement to allow 1899, LLC to assume responsibility for one (1) of three (3) available electric meters at Easton’s Beach and establish a RI Energy account for the electric service in their own name and billed directly to them; and

WHEREAS: City Council Resolution 2025-71 allowed 1899, LLC to install a water submeter in the rotunda with a separate usage reader, in which the city will invoice 1899, LLC accordingly for water usage during the lease period with 1899, LLC; and

WHEREAS: 1899, LLC has requested the City to exercise the option to extend said agreements for the calendar year 2026 at the same terms and conditions; NOW THEREFORE BE IT

RESOLVED: the request to exercise option year two (2) of the agreement with 1899, LLC to provide mobile food and beverage concessions at Easton’s Beach for the calendar year 2026 is hereby accepted, and the Council Chair is authorized to sign said agreement on behalf of the City, upon review by the City Solicitor.
