WHEREAS, Rhode Island General Laws § 42-46-5 (a) specify that a public body may hold a meeting closed to the public pursuant to § 42-46-4 for, among other purposes, the following: (1) any discussions of the job performance, character, or physical or mental health of a person or persons provided that the person or persons affected shall have been notified in advance in writing and advised that they may require that the discussion be held at an open meeting; and
WHEREAS: The City Council should at this time review and evaluate the job performance of the City Manager who started his employment with the City of Newport on July 15, 2024, especially in light of the City hirings of several senior level administrators since then; NOW THEREFORE BE IT
RESOLVED: That the Newport City Council shall meet in Executive Session, pursuant to Rhode Island General Laws, on or before Friday, February 28, 2025; AND BE IT FURTHER
RESOLVED: That the city clerk of the City of Newport or the deputy city clerk of The City of Newport in the event that the city clerk is unable to do so, shall conduct a poll of Newport City Council members to determine a date, time and location that is acceptable to a majority of the members of the Newport City Council and then shall report to the members of the city council the results of the poll, and shall subsequently, via compliance with all applicable state laws pertaining to publication notices of said meeting, provide notice of the executive session; AND BE IT FURTHER
RESOLVED: That the city solicitor for the City of Newport shall, to the degree necessary and appropriate, advise the city clerk, assistant clerk and members of the city council regarding any legal matters concerning what is approved of herein.
