RESOLUTION

OF THE
COUNCIL

No. 2025-180

WHEREAS: the City of Newport operates its Wastewater Pollution Control Facility under Contract 15-023 with Veolia Water North America – Northeast, LLC, governing operations, maintenance, and capital improvements necessary for compliance with state and federal law; and

WHEREAS: the City Council by Ordinance No. 2014-016 authorized issuance of Wastewater System Revenue Bonds up to $50 million to fund design, construction, and rehabilitation of wastewater facilities and CSO program upgrades; and

WHEREAS: the City Council by Resolution No. 2016-60 awarded Contract 15-023 to Veolia Water North America – Northeast LLC for Design-Build-Operate services for the Water Pollution Control System; and

WHEREAS: the City Council by Resolution No. 2024-44 approved a Capital Modification under Contract 15-023 for Primary Clarifier improvements valued at $525,422; and

WHEREAS: Action Item #6521/25 (October 22 2025) documented additional corrosion and structural deficiencies requiring completion of the Clarifier and Process Improvements Project; and

WHEREAS: the City remains subject to the Clean Water Act (33 U.S.C. §1251 et seq.), the Rhode Island Pollutant Discharge Elimination System Permit RI0100293, and the EPA Consent Decree (Case No. 08-265S); and

WHEREAS: additional Clean Water State Revolving Fund financing through the Rhode Island Infrastructure Bank is necessary to complete the Project. NOW, THEREFORE, BE IT

RESOLVED: that the City Council of the City of Newport authorizes borrowing of up to twenty million dollars ($20,000,000) through the Rhode Island Infrastructure Bank Clean Water State Revolving Fund for completion of the Wastewater Pollution Control Clarifier and Process Improvements Project under Contract 15-023; AND BE IT FURTHER

RESOLVED

RESOLVED: RESOLVED that the City Manager and Director of Finance are authorized to execute loan agreements, certifications, and related documents with RIIB and to amend Contract 15-023 as necessary to complete the Project and maintain regulatory compliance; AND BE IT FURTHER

RESOLVED: that the Utilities Department shall report to Council upon loan closing and project completion, summarizing total funding sources and confirming continued compliance with the Clean Water Act, RIPDES Permit RI0100293, and Consent Decree.
