AN ORDINANCE IN AMENDMENT OF TITLE 14 OF THE CITY OF NEWPORT, RHODE ISLAND, AMENDED, ENTITLED, "LAND USE"

BE IT ORDAINED by the City of Newport:

THE CODIFIED ORDINANCES REVISION OF 1994, AS SECTION 1. Chapter 14.04 of the Codified Ordinances of the City of Newport, RI, revision of 1994, as amended, entitled, "Comprehensive Land Use Plan," is hereby further amended as follows:

14.04.010. Comprehensive Planning and Land Use Act.

(a) Legislative Findings. The Rhode Island Comprehensive Planning and Land Use Act, Title 45, Chapter 22.2-2 requires that all Rhode Island communities adopt a comprehensive plan to be in conformance with the Act, and, the planning board for the City of Newport did hold the necessary public hearing with the required advertising, and did forward the plan with a recommendation for city council adoption, and the city council did hold the necessary public hearing with the required advertising.

(b) The comprehensive plan of the City of Newport, Rhode Island, as duly adopted and updated from time to time, and as most recently updated and approved by the City Council on February 8, 2017, and first amended on January 27, 2021, and most recently amended on September 11, 2024, is hereby incorporated by reference in its entirety. The comprehensive plan shall take effect for the purpose of conforming municipal land use decisions and for the purpose of being transmitted to the Rhode Island Director of Administration for state review upon public hearing and passage.

The comprehensive plan and any amendments thereto shall not become effective for the purposes of guiding state agency actions until it is approved by the State of Rhode Island pursuant to Chapter 45-22.2 of the General Laws of Rhode Island, a/k/a the Rhode Island Comprehensive Planning and Land Use Act.

SECTION 2. This ordinance shall take effect upon its passage and all ordinances or parts of ordinances inconsistent herewith are hereby repealed.
