2026-30 Emmanuel Church Parking Lot – Agreement

Resolution

WHEREAS, Emmanuel Trust owns a parking lot for the use of Emmanuel Church across Dearborn Street, located at 42 Dearborn Street in Newport (the “Parking Lot”); AND

WHEREAS, Emmanuel Church, a house of worship, community center, and the home of Newport Classical, uses the parking lot for its worship services, other events, respective employees and volunteers, and certain paid parkers; AND

WHEREAS, the City of Newport currently provides public parking in various locations in Newport, but does not have public parking available in the area of Emmanuel Church, an area of significant restaurant, shopping, and event parking needs, particularly during the summer season; AND

WHEREAS, Newport City Ordinance Section 10.28.020 provides that Newport’s Council “may, upon request of the director of public safety... authorize the city manager to negotiate for city control of private property for public parking purposes,” whereupon such lot shall be a “public parking lot”, therefore previously resulting in an agreement between the City and Emmanuel Church during the 2024 and 2025 summer seasons; AND

WHEREAS, Newport will again patrol the Parking Lot frequently during peak parking hours, that Emmanuel Church agrees that Newport may charge fees consistent with the other public parking lots Newport owns or controls, with net parking fee revenue (gross parking fees less operating expenses) shall be distributed to Emmanuel Church, and term of this agreement shall be for the 2026 parking season, May 1 through October 31; NOW THEREFORE BE IT

RESOLVED: in consideration of the premises, and agreements herein contained, Emmanuel Church hereby grants Newport license to control the Parking lot for public parking purposes, in accordance with limited Exceptions of the agreement, to manage and control the Parking Lot for public parking purposes, enforcing Newport City Ordinance Section 10.28.021, subject to Emmanuel Church’s uses as set forth in the preceding Section 1, and shall provide signage, advising users desiring to park in the Parking Lot of Newport’s parking app used in other Newport public parking lots; AND BE IT FURTHER

RESOLVED: that the Newport City Council approves the agreement for City control of the private parking lot of Emmanuel Church for public parking purposes, and the City Manager is authorized to sign said agreement on behalf of the City, upon review by the City Solicitor.
