RESOLUTION

COUNCIL
No.2025-193
WHEREAS, in 1999, the City of Newport entered into a lease agreement with Sprint PCS/(now) T-Mobile, USA Inc. (Lessee), for a period of 25 years, totaling $647,260, at 20 Freebody Street for the placement of certain cellular equipment; and
WHEREAS, the Lessee desires to enter into this first amendment in order to extend the term of the agreement for an additional 25 years, totaling $1,434,626, and to otherwise modify and amend certain provisions of the agreement, including the installation, maintenance and upgrades of equipment as indicated in a 3/5/2021 letter to the City; NOW THEREFORE BE IT
RESOLVED: that this new agreement be reinstated in its entirety, as amended herein in all respects as if the agreement never expired, for a period of 5 years, with four additional five-year renewal options; AND BE IT FURTHER
RESOLVED: that this agreement is hereby approved, and the Council Chair is authorized to enter into such Lease Agreement Amendment on behalf of the City, subject to review and approval of the document by the City Solicitor.
