AN ORDINANCE IN AMENDMENT OF TITLE 10 OF THE CODIFIED ORDINANCES OF THE CITY OF NEWPORT, RHODE ISLAND, REVISION OF 1994, AS AMENDED, ENTITLED, "VEHICLES & TRAFFIC":
BE IT ORDAINED by the City of Newport:
SECTION 1. Chapter 10.32 of the Codified Ordinances of the City of Newport, RI, Revision of 1994, as amended, entitled, "RESIDENTIAL PARKING PROGRAM" is hereby further amended, as follows:
DELETE SECTION 10.32.140 IN ITS ENTIRETY
10.32.140. Revocation of permits.
In addition to the penalties set forth in Section 10.32.150, the city manager shall have the responsibility and authority to revoke the residential parking permit of any resident for the abuse of a residential parking permit or for the use of the same in a manner contrary to any of the provisions of this chapter. Revocation of the residential parking permit of a resident or conviction of a resident for a violation of any of the provisions of this chapter shall be considered just cause for denial of a future residential parking permit to such resident.

ADD IN LIEU THEREOF THE FOLLOWING:
10.32.140. Revocation of permits.
No person shall provide false, fraudulent or misleading information or documentation in applying for or obtaining a residential parking permit or misuse or use a residential parking permit in a manner contrary or in violation of the provisions of Chapter 10.32 of the Codified Ordinances of the City of Newport. A violation of this section may be punished by a fine of up to one thousand ($1,000) dollars and/or the
revocation of residential parking permits issued and/or the denial of future residential parking permits to such person in the future.
The providing of false, fraudulent or misleading information in obtaining a residential parking permit may also be subject to criminal prosecution before a court of competent jurisdiction.
SECTION 2. This ordinance shall take effect upon its passage and all ordinances or parts of ordinances inconsistent herewith are hereby repealed.
