NO. 2024-13

AN ORDINANCE IN AMENDMENT OF TITLE 2 OF THE CODIFIED ORDINANCES OF THE CITY OF NEWPORT, RHODE ISLAND, REVISION OF 1994, AS AMENDED, ENTITLED, "ADMINISTRATION."

BE IT ORDAINED by the City of Newport:

SECTION 1. Chapter 2.68 of the Codified Ordinances of the City of Newport, Revision of 1994, as amended, entitled, "Planning Board," is hereby further amended as follows:

2.68.040. Federal, state and local assistance.

A. The planning board may call upon all other departments, boards or agencies of the city and agencies of the state and federal governments for assistance in the performance of its designated functions and shall cooperate with such other city departments and with state and federal agencies on community, regional and state planning and development. All city officials, boards and agencies shall, upon request, furnish the board such available information as it may require for its work.

B. Technical review committee. The following members of city departments or their designees shall sit from time to time as a technical review committee:

City planner (administrative officer).

Zoning officer.

Director civic investment.

Director public services.

Director utilities.

Director zoning and inspections.

Preservation planner.

City engineer.

Buildings and grounds supervisor fire marshal.

Traffic sergeant, or other selected official from the Newport Police Department.

The purpose of the technical review committee shall be to assist the planning board by providing professional and technical advice, comment and recommendations on matters referred to the technical review committee by the planning board and also for any required zoning development plan review with the intent to promote more informed decision making by the planning board. Reports from the technical review committee providing findings and recommendations shall be advisory and non-binding on the planning board.

The technical review committee shall also serve as the review agency for development plan review for applications for uses that are permitted by right if it is set forth in and established by the zoning ordinances as the review agent for the same. A written record of the technical review committee's proceedings shall be maintained and made a part of the record of any development application.

The city planner shall serve as the administrative officer of the technical review committee which shall meet as necessary.

2.68.080. Subdivision regulations.

For the purpose of promoting the general health, safety and general welfare, by governing and restricting the plotting and subdivision of land in the city, the planning board is authorized to adopt rules and regulations governing and restricting the plotting or other subdivision of land within the city, and from time to time to modify and amend such rules and regulations as it may adopt. The board is further authorized to control the subdivision of land within the city pursuant to such rules and regulations and subject to and in accordance with the provisions of Title 45, Chapter 23, of the General Laws.

For the purpose of promoting the general health, safety and general welfare, by governing land development and subdivision projects in the city, the planning board is authorized to adopt rules and regulations governing and restricting the plotting or other subdivision of land within the city, and from time to time to modify and amend such rules and regulations as it may adopt. The board is further authorized to control land development and subdivision of land within the city pursuant to such rules and regulations and subject to and in accordance with the provisions of Title 45, Chapter 23, of the General Laws.

SECTION 2. This ordinance shall take effect upon its passage and any ordinances or parts thereof inconsistent herewith are hereby repealed.
